LIABILITY WAIVER AND AGREEMENT

I sign this waiver and agreement as partial consideration for access to classes hosted, taught, and lead by Peaceful Warrior Yoga LLC, also known as and doing business as “Downtown Yoga Center” (hereinafter “Peaceful Warrior Yoga LLC”). All references to Peaceful Warrior Yoga herein, shall also apply to and protect Kim Hobbs in her individual capacity to the same extent they apply to protect Peaceful Warrior Yoga LLC and it’s corresponding entities. By signing this waiver, I hereby acknowledge and agree that yoga as well as any and all other classes offered by Peaceful Warrior Yoga LLC (hereinafter, collectively referred to as “Classes” or “Class”) involve physical activity that may not be appropriate for individuals with certain physical limitations. Each Class requires different skill or ability level, and physical capabilities, I hereby acknowledge and agree that I have and will continue to educate myself on the skill/ability level, and physical requirements of each Class and attend and/or participate only in Classes within my skill/ability level, and physical capabilities. I further recognize, acknowledge and agree that I am attending and participating in Classes at my own risk. By signing this waiver and agreement, I hereby agree to waive any and all past, current, and future claims that have accrued or may accrue against Peaceful Warrior Yoga LLC, any instructor working on behalf of Peaceful Warrior Yoga LLC, or the owner of any property on which Peaceful Warrior Yoga LLC offers Classes. I hereby state, acknowledge, and agree that each time I register for, attend, or participate in a Class, I restate, reaffirm, and recommit to the provisions of this waiver and agreement as they relate to past, current, or future claims that I may have against Peaceful Warrior Yoga LLC, any instructor working on behalf of Peaceful Warrior Yoga LLC, or the owner of any property on which Peaceful Warrior Yoga LLC offers Classes. All parties hereto agree that instructors instructing classes on behalf of Peaceful Warrior Yoga LLC and the owners of property on which Peaceful Warrior Yoga LLC offers Classes are intended third-party beneficiaries of this waiverand agreement.

I hereby acknowledge and agree that I am aware of and understand my personal physical limitations and will not attempt to participate in any Class that may be inappropriate for someone with my physical limitations. In any Class I participate in, I agree that I will continuously self-assess and will not attempt any activities that could result in injury of any kind. I accept full responsibility for any harm or injury occurring in or resulting from Classes. Should it become necessary to render medical care to me, I hereby consent to the rendering of said medical care. On occasion photographs, videos, or other recordings may be made for promotional purposes. I hereby acknowledge, consent and agree that Peaceful Warrior Yoga LLC may use any photograph, video, or other recording in which I appear, for promotional purposes. Authorized uses include use by Peaceful Warrior Yoga LLC as well as any sponsors or licensees anywhere, in any medium, for an unlimited period of time. I understand, acknowledge, and agree that I will not have an opportunity or approve uses of my likeness nor will I be compensated for the use of my likeness in marketing or promotional materials.

I have read and fully understand the terms and provisions of this waiver and agreement. I am aware that by signing this agreement, I am waiving legal rights as described herein.
